Are Bexar County Court Records Public?

Yes. Court records in Bexar County and in all of Texas are considered public records. However, unlike other government records, Bexar County courts do not fall under the Texas Public Information Act, as the act does not govern access to the judiciary. Instead, court records are presumed to be open to the public under the state's common law and several judicial rules.

Although court records are generally presumed to be public, this is not always the case. Public access to a Bexar County court record is constrained where the law prohibits disclosure or if the court seals the record, typically to protect privacy or safety. Bexar County Court Records Search

Below are several ways through which individuals can access court records in Bexar County.

Online Access

The Bexar County Justice Portal is the primary online point of access for Bexar County court records. Members of the public are not required to register for an account or pay a fee to use the portal. The portal gives researchers access to records from the District Clerk's Office and County Clerk's Office. However, the following District Court cases are not present on the portal:

  • Child protection
  • Adoption
  • Gestational parenting
  • Investigation of child abuse
  • Mental examination

Document images are also not available on the Justice Portal. To access document images, individuals can visit the court in person or request the document through the mail. Municipal Court and Justice of the Peace Court records also have to be obtained outside the portal.

In-Person Access

Individuals can access a Bexar County court record in person by visiting the Clerk of Court's Office, where the record is filed (typically the clerk of the court that handled the case). Researchers will need to provide the clerk with the names of the parties involved in the case or the case number to locate the record. The clerk may also charge a search fee and a copy fee, depending on the request.

Mail and Phone Requests

Individuals who live far away from the court and cannot visit in person to obtain copies of court records are not disadvantaged. A request for the record may be written down and mailed to the appropriate clerk's office. The written request should include the case number, the names of the parties, the file date range, and the specific documents needed. The request should be mailed along with payment for the copies (check or money order) and a self-addressed, stamped envelope. Requesters can call the respective Clerk of Court's Office to confirm how much the copies will cost.

Fees for Court Records in Bexar County

Bexar County court records can be viewed on the Bexar County Justice Portal without paying a fee. However, if an individual wants physical copies of a record and visits the Clerk of Court's Office or sends in a request by mail, they will be charged a fee. The fees for copies are as follows:

  • Regular Copies: $1 per page
  • Certified Copies: $5 per document plus copy fees
  • Emailed Copies: $1 for the first 10 pages, then 10 cents per page for subsequent pages
  • Search fee (for name searches) $5
  • Change of Name Certificate: $10

Criminal Records Access in Bexar County

Bexar County criminal records are files maintained by law enforcement agencies and Bexar County courts about an individual's interaction with the county's criminal justice system. The DPS, in response to the request, will then issue a criminal history record. Only subjects of a record may submit a request.

Examples of probate records are wills, letters testamentary, guardianship files, trusts, and estate inventories.

The Bexar County Probate Courts (1, 2, and 3) handle all probate matters in the county. Probate records are generally open to the public, except for certain confidential files (e.g., private medical documents). Individuals can look up probate records on the Bexar County Justice portal or at the County Clerk's Office.

Bexar County Family Court Records

Bexar County family court records encompass legal matters that involve families and domestic relationships. These legal matters include name changes, divorce, child custody and support, adoption, and protective orders. Family law cases are exclusively handled by the Civil District Courts.

Individuals who want to access a family court record in the county may search the Bexar County Justice Portal using a name or case number. Copies of a record may also be obtained in person at the District Clerk's Office for a fee. Requesters should note that confidential information will not be disclosed to them unless they are a party to the record.

Federal Court Records in Bexar County

Federal court records are documents from cases involving federal law and do not fall under the Bexar County or Texas court systems. Instead, these records are managed by the United States District Court for the Western District of Texas and the United States Bankruptcy Court for the Western District of Texas.

Both federal courthouses are located in San Antonio. Individuals can visit either courthouse to gain access to their records or search for the record online through the Public Access to Court Electronic Records (PACER) portal.
